Dog By-law


THE CORPORATION OF THE
TOWNSHIP OF BLANDFORD-BLENHEIM
BY-LAW NUMBER 1313-2000

Being a By-law requiring the licensing of dogs and for imposing a licence fees on the owners of them and for regulating the running at large of dogs within the Township of Blandford-Blenheim.

WHEREAS the Ontario Municipal Act, R.S.O. 1990, Chapter M.45, Section 210, Subsection 11, provides the authority for Councils of local municipalities for licensing and requiring the registration of dogs and for imposing a licence fee on the owners of them.

AND WHEREAS Section 210, Subsection 13 of the said Act provides the Authority for Councils of a local municipality to regulate the running at large of dogs in the municipality, for seizing and impounding and for killing, whether before or after impounding, dogs running at large contrary to the by-law and for selling dogs so impounded at such time and in such manner as is provided by this by-law.

NOW THEREFORE the Council of the Corporation of the Township of Blandford-Blenheim enacts as follows:

SECTION 1 - DEFINITIONS
1.1This by-law may be cited as “The Dog By-law”.
1.2 “Act” means the Municipal Act, R.S.O. 1990, Chapter M.45 as may be amended from time to time.
1.3 “By-Law Enforcement Officer(s)” means a person or persons empowered by the Municipal Council to enforce the various by-laws of the Township and to carry into effect the provisions of any Act of the Legislature to be enforced by the Municipality;
1.4 “Provincial Offences Officer” means the By-law Enforcement Officerof the Township.
1.5 “Dog” means a male or female dog after it has been weaned from its mother.
1.6 “Owner” of a dog includes a person who possesses or harbours a dog, and “owns” and “owned” have a corresponding meaning.
1.7 “Kennel of Dogs” means registered or eligible for registration with an association incorporated under the Animal Pedigree Act (Canada).
1.8 “Regulations” means the regulations passed pursuant to the Act.
SECTION 2 - LICENCE FEE
2.1Every owner of a dog or dogs in the Township of Blandford-Blenheim immediately upon becoming such owner shall cause such dog or dogs to be licensed in the office of the Tax Collector, of the Township of Blandford-Blenheim. Licenses shall be renewable annually on the first day of January of each and every year.
2.2The license fee applicable thereto which is hereby imposed on such owner is as follows:
2.2.1 For every dog$15.00
2.2.2The owner of a Kennel of Dogs$35.00
2.2.3An additional $5.00 fee shall be imposed to the rates outlined in Sections 2.2.1 and 2.2.2, after April 1st of each year.
SECTION 3 - DOGS RUNNING AT LARGE
3.1 No person shall allow the running at large of a dog, or dogs within the Township of Blandford-Blenheim. A dog or dogs shall be deemed to be running at large when found in any place other than the premises of the owner of the dog and not under the control of any person.
3.2 A dog which is found running at large contrary to the provisions of Section 3.1 of this By-law may be seized and impounded by the action of the Provincial Offences Officer, through the canine control officer or organization designated by the Township of Blandford-Blenheim.
3.3 The Provincial Offences Officer of the Township at any time may direct that a dog be killed if such dog is found running at large and such dog cannot be seized and impounded by the action of the Provincial Offences Officer, through the canine control officer or organization designated by the Township of Blandford-Blenheim to pick up dogs running at large.
SECTION 4 - PENALTIES
4.1 Any person who contravenes any provisions of this By-law is guilty of an offence and upon conviction is liable to a fine or penalty as provided in the Provincial Offences Act.
4.2 That all penalties imposed by a judicial officer are recoverable under the Provincial Offenses Act and together with such costs and expenses as are imposed thereunder.
SECTION 5 - DOG OWNER’S LIABILITY
5.1 The owner of a dog is liable for damages resulting from a bite or attack by the dog on another person, and the proceedings referred to in the Dog Owner’s Liability Act, R.S.O. 1990, Chapter D.16.
SECTION 6 - OTHER
6.1 By-law Number 1000-93 enacted the 1st day of December, 1993, is hereby repealed.
